SynergyOS Copilot Product Specific Terms
Your agreement consists of these Product Specific Terms for SynergyOS Copilot, combined with your main agreement with us – the SynergyOS Customer Agreement’s General Terms, or the SynergyOS Corporate Terms of Service or similar legacy agreement. This combined document is the “Agreement.”
These terms apply to SynergyOS Copilot Personal, SynergyOS Copilot Business, SynergyOS Copilot Enterprise, and any other SynergyOS Copilot plans or tiers (including paid, free, beta, and trial plans), in each case when purchased or provisioned directly from SynergyOS, unless a particular SynergyOS Copilot plan or feature is expressly governed by separate written product-specific terms.
By using SynergyOS Copilot, you agree to the General Terms unless you and SynergyOS have another Agreement in place, and you agree to any applicable Data Protection Agreement unless your Agreement with SynergyOS already includes a different data protection agreement.
These terms may only be modified in a written document signed by you and SynergyOS. Capitalized terms not defined here have their respective meanings given in the Agreement.
SynergyOS Copilot may be offered in different plans or tiers (for example, Personal, Business, Enterprise, free, preview, and trial plans). Unless a section below clearly states that it applies only to a particular plan or tier, all sections of these Product Specific Terms apply to all SynergyOS Copilot plans and tiers.
- Using SynergyOS Copilot.
SynergyOS Copilot is a suite of generative AI capabilities that may be made available across one or more SynergyOS products and channels. These capabilities can include, for example, conversational assistants, content and document generation, summarization, translation, workflow orchestration, search and retrieval, data analysis, code completion and generation, recommendations, and other AI-powered features (each, a “Copilot Capability”).
SynergyOS Copilot may be accessed in various ways, including but not limited to: within SynergyOS applications, as tools or extensions within productivity or development applications, through a command-line interface, via web or mobile applications, embedded into workflow or business applications, or through APIs and integrations. Some Copilot Capabilities may require you to install an extension, plugin, add-on, or similar component.
- Ownership of Suggestions and Your Content.
SynergyOS does not own Suggestions. Subject to the Agreement, you retain ownership of Your Content.
- Responsibility for Your Content and Use of Suggestions.
You retain all responsibility for Your Content and for how you use Suggestions, including any use of Suggestions to create, modify, or support Your Content or any other output, workflows, or decisions. It is entirely your decision whether to use Suggestions generated by SynergyOS Copilot.
If you use Suggestions, SynergyOS strongly recommends that you have reasonable policies and practices in place designed to prevent the use of a Suggestion in a way that may violate the rights of others, applicable law, or your own internal policies. This includes, but is not limited to, using any filtering, policy enforcement, safety, or governance features available in SynergyOS Copilot and in the broader SynergyOS platform.
- Defense of Third Party Claims.
If your Agreement provides for the defense of third party claims, that provision will apply to your use of SynergyOS Copilot, including to the Suggestions you receive.
- Acceptable Use.
Your use of SynergyOS Copilot is subject to the SynergyOS Acceptable Use Policies, any applicable AI or generative AI code of conduct that SynergyOS designates, and any applicable required mitigations or similar safety measures identified by SynergyOS from time to time. For example, you may not prompt SynergyOS Copilot with content that is unlawful or otherwise prohibited by the applicable acceptable use policies, and you may not use SynergyOS Copilot to generate Suggestions whose use you know (or reasonably should know) would be unlawful or would infringe on the rights of others.
- Data.
A. Generally. SynergyOS Copilot sends an encrypted Prompt from you to SynergyOS (and/or to its authorized subprocessors or infrastructure providers) to provide Suggestions and operate Copilot Capabilities. Depending on your configuration, the plan or tier you use, and the specific Copilot Capabilities you use, SynergyOS Copilot may also process other contextual information and telemetry necessary to deliver, secure, and improve the service. Except as detailed below and in the SynergyOS Privacy Statement, Prompts are transmitted only to generate Suggestions in real time, are deleted once Suggestions are generated, and are not used for any other purpose. Prompts are encrypted during transit and are not stored at rest without your permission, unless otherwise stated in the Agreement, the SynergyOS Privacy Statement, or relevant documentation.
B. When Prompts are Retained. Your Prompts are retained by SynergyOS in the following circumstances:

Multi-Channel Tools and Experiences. If you use SynergyOS Copilot tools or Copilot Capabilities in any channel, such as SynergyOS Copilot in web or mobile applications, within SynergyOS products, inside productivity or development tools, via APIs, or in other channels (including command line interfaces and chat experiences), SynergyOS Copilot may retain your Prompts to those tools to provide the service and to operate, maintain, secure, and improve those tools and capabilities, as permitted under the Agreement.

Private Language Models and Configurations. If you have requested a customized private language model, private AI configuration, or other tenant-specific AI configuration for your organization, SynergyOS Copilot may retain your Prompts (and, where applicable, associated output and metadata) to fine-tune, configure, or otherwise support your private model or configuration, consistent with the Agreement and any applicable data protection terms.

Custom Settings and Integrations. If you have configured SynergyOS Copilot to use alternative data handling, such as enabling interaction with third party extensions, plug-ins, connectors, or integrations, or enabling additional logging or retention settings, SynergyOS Copilot will retain and process your Prompts (and related data) based on that configuration and any consents or settings you select.

Free, Preview, and Trial Plans. For certain free, preview, or trial SynergyOS Copilot plans or tiers, SynergyOS Copilot data (including Prompts, Suggestions, and related usage data) may be used for AI model training, evaluation, and improvement, and may be shared with or processed by third-party large language model providers and other subprocessors, as described in the SynergyOS Privacy Statement and in your Copilot or account settings.
For paid SynergyOS Copilot plans, SynergyOS Copilot data (including Prompts, Suggestions, and related usage data) may also be used for AI model training, evaluation, and improvement, and may be shared with or processed by third-party large language model providers and other subprocessors, as described in the SynergyOS Privacy Statement and in your Copilot or account settings, unless you opt out of such use in your Agreement or by disabling it in your Copilot or account settings.
C. More Information. More detailed information on how data is processed by SynergyOS Copilot, including the categories of data processed, purposes of processing, and data retention and AI model training practices across different Copilot Capabilities, plans, and channels, is available in the SynergyOS Privacy Statement or other privacy documentation described in the Agreement.
- Support.
Paid SynergyOS Copilot plans include Support as described in SynergyOS’s support programs applicable to your Agreement. Free, preview, and trial plans may have limited or no Support, as described in the applicable SynergyOS documentation.
- Optional Pre-Release and Preview Products.
SynergyOS Copilot is under active development. From time to time, SynergyOS may allow you to opt in to experimental functionality or to preview experimental SynergyOS Copilot services or features that are not generally available (each, a “Preview”). If you choose to participate in a Preview, your use of the applicable pre-release software or services is governed by this document, together with the Agreement.
- Definitions.
“Acceptable Use Policies” means the SynergyOS acceptable use policies or similar documentation referenced in the Agreement and as updated from time to time.
“AI Code of Conduct” means any SynergyOS generative AI services code of conduct or similar set of guidelines that SynergyOS identifies as applicable to SynergyOS Copilot.
“Copilot Capabilities” has the meaning given in Section 1 and includes all SynergyOS Copilot generative AI features and experiences made available to you under the Agreement.
“Content” and “Your Content” mean any content, code, data, prompts, documents, messages, files, or other materials that you or your end users provide to or through SynergyOS Copilot, including your modifications to a Suggestion.
“Data Protection Agreement” means any data protection agreement, data processing addendum, or similar document between you and SynergyOS that governs the processing of personal data in connection with SynergyOS Copilot.
“General Terms” means the SynergyOS Customer Agreement’s General Terms or other main agreement between you and SynergyOS that governs your use of SynergyOS services.
“Prompt” means the collection of Content and supporting contextual information that SynergyOS Copilot sends to SynergyOS (and/or its authorized subprocessors or infrastructure providers) to generate Suggestions or operate Copilot Capabilities, including data you submit through any chat, conversational, or API interface.
“Required Mitigations” means any required mitigations, filters, or safety features that SynergyOS identifies as applicable to SynergyOS Copilot.
“Suggestions” means the content, code, functions, text, images, recommendations, and other output returned to you by SynergyOS Copilot.
“Support” means SynergyOS’s support programs applicable to SynergyOS Copilot and described in the Agreement or related documentation.
